The use of the potential-based strategy model as copyrighted content and the use of the trademark pbsm require a license according to the respective degree and the respective application of the pbsm.
The following are the license terms for the use of the potential-based strategy model for the respective financial statements.
1. type of license
1.1 All licenses are simple, non-exclusive licenses tied to the respective degree and to the person who completed that degree. The licenses cannot be sold, transferred, passed on or sublicensed.
1.2 The scope of the licenses differs according to the respective degree.
2 Scope of license pbsm.User
2.1 The license pbsm.User permits the use and application of the potential-based strategy model, parts thereof or contents thereof for the licensee’s own company pbsm.User or the company in which the licensee is employed as a permanent employee. The use for the own company / the company in which the licensee is employed exclusively includes the application for the company’s own social media strategy.
Training employees of your own company in the use of the method is part of this license. Participants in this in-house training do not receive their own license, nor are they entitled to entry in the user directory or use of the trademark or a conclusion of the method.
2.2 The license does not include the use for other companies – for example as a consultant, agency or other service provider. This application is explicitly not included in the pbsm.user license and requires its own license. The same applies to freelance employees of the Company. Companies in this sense are independent legal entities and natural persons.
2.3 The Licensee may use the pbsm trademark as part of the name of the degree, for internal company work materials and in the external presentation of its professional competence as an employee, such as in job applications or in professional profiles on social networks such as Xing or LinkedIn.
2.4 The license pbsm.user is not subject to any time limit. However, it ends when users violate the license terms.
3 Scope of license pbsm.Strategist
3.1 The license pbsm.Strategist permits the use and application of the potential-based strategy model, parts thereof or contents thereof for the licensee’s own company or the company in which the licensee is employed as a freelancer or permanent employee.
3.2 The license pbsm.Strategist also includes the application of the potential-based strategy model for other companies – for example as a consultant, agency or other service provider.
Training of employees of your own or other companies in the application of the method is part of this license. Participants in this in-house training do not receive their own license to use the method, nor are they entitled to be listed in the user directory or to use the trademark or a conclusion of the method.
3.3 The Licensee may use the trademark pbsm in the as part of the designation of the financial statements, for internal and external company working materials, in the external presentation of its professional competence as an employee and for the external presentation of its competence as a consultant or other service provider.
3.4 The pbsm.strategist license is an annual license. I.e. the license must be renewed annually. The license renewal can be connected with the method update or can be done independently. License holders receive a notice of license renewal and decide whether to renew the license. If this is not the case, the license expires. The license expires without replacement in case of violation of the license conditions.
3.5 The personal license for trademark use from the conclusion pbsm.strategist does not include use by companies. This means that the personal license does not permit the use of the trademark for the general marketing of company services, but does permit reference to the competence of specifically named employees, provided that the respective service is provided by these employees. A company license is required for the use of the brand and method by companies.
4 Duties of the Licensee
4.1. Obligation to inform
In the case of strategy developments that are based wholly or partly on the potential-based strategy model, it is necessary to name and link the method (pbsm.info).
4.2 Reference to copyright holders and trademark holders
In all applications of the potential-based strategy model pbsm, the license holder refers to the copyrights and trademark rights by means of a linked notice in all digital and non-digital internally and externally used content, work materials and documents.
4.3 Duty of timeliness in the application of the method
By accepting the license, the licensee undertakes to be up-to-date in the application of the method. This includes the obligation to update the acquired knowledge if necessary. The content for this is provided in digital form and may be subject to a charge.
5 Misuse / use beyond the scope of use
Misuse of a license is the use of content and trademark beyond the agreed use or a breach of the licensee’s obligations. Misuse is given if the trademark or contents are used for other purposes or to an extent other than described in the respective licenses. Misuse will void the license and may result in claims for damages.
